Knix Wear, Inc. and its affiliates, including Knix and KT by Knix (hereinafter referred to as “Knix,” “we,” “us,” or “our”) respects your concerns about privacy. This Privacy Policy (“Policy”) explains what personal information we collect through our websites, stores, and services (the “Services”), how we use that information, to whom we disclose it, and how we safeguard personal information. Unless indicated otherwise, this Policy applies only to personal information collected through the Services operated by Knix that expressly adopt, display or link to this Policy, and only to the extent indicated.

I. WHAT INFORMATION DO WE COLLECT AND HOW DO WE USE IT?

1. Information You Voluntarily Provide

When you visit and interact with our Services, you may provide us directly with certain personal information and other information, such as your:

• name,

• billing address,

• shipping address,

• phone number,

• email address,

• account login information (e.g., your email address and a password you create),

• social media username,

• interests and personal preferences,

• payment card information (including card number and security code),

• purchase and ordering information,

• demographic information (such as your gender, age, or birth date),

• responses to survey questions,

• sizing information,

• information contained in your communications with us, and

• any other information you choose to provide.

Our Services may also give you the option to upload or share pictures or videos of yourself and others and to post comments and product reviews. This information will be public, so please use care in what you post

We may also collect information that you provide on our Services about people you know. For example, we collect your gift recipient’s contact information to process your gift orders. We may also collect information about your friends and family members when you participate in one of our referral programs, such as an email inviting your friend to use our Services. Please only share with us contact information of people you know.

When you apply for our Educate + Empower program, we collect personal information from you, such as your role (e.g., educator, student), the type and name of entity or organization for which you are requesting the program package, number and age of teens who will use the package, and/or your planned use of our demo.

2. Information Your Devices Provide Automatically

When you interact with our Services, we also obtain information about you automatically, including the following:

a. Location Information

We may obtain information about your location when you access or use our Services: for example, via your browser information and other similar device or browser attributes (like IP address), our store locator page, or our mobile applications. For more details about how you can control the collection of location information, please see the Your Privacy Rights section below.

b. Navigational Information

When you access our Services, your device may provide navigational information, such as browser type and version, service provider identification, IP address, the site or online service from which you came, the pages you visit on the Services, and any other site or online service to which you navigate.

c. Device Information

We also may obtain information about the computer or mobile device you use to access our Services, such as the hardware model, operating system and version, identification numbers assigned to your mobile device, mobile network information, and website or app usage behavior.

3. Information Derived Through or Provided By Others

Affiliated entities, vendors, business partners, social media networks, and advertising networks also provide us with, or supplement, information about you. In some cases, these parties may also collect information about you when you use or interact with our Services, including through the use of cookies and other similar technologies. We use this information for operational or marketing purposes, such as to correct shipping information, market to you, deliver more relevant offers through customer insights, improve our business, and transact business. 4. How We Use the Information We Obtain

We combine the information we collect about you and use your personal information, individually or combined, to:

1. provide our products and services, including the Services;

2. process your online orders;

3. facilitate payment and transactions;

4. create and manage your online account;

5. perform analytics;

6. personalize and provide you with content and offers that are tailored to your interests;

7. provide customer service and respond to your inquiries and requests;

8. include you in surveys, rewards programs, contests, and other promotions where we have your consent;

9. enable you to post your content, such as comments, images or videos;

10. facilitate networks of online social activity centered around our products and services;

11. improve our products and services, including the Services, the manner in which offers are made on our Services, and the interactions and experience visitors have with our Services;

12. enable you to interact with third-party content service providers, whether by linking to their sites, viewing their content within our online environment, or by viewing our content within their online environment;

13. market our products and services that may be of interest to you;

14. maintain system security;

15. comply with laws and respond to legal requests;

16. protect our rights and property and the rights and property of others; and

17. create aggregated, de-identified, pseudonymized, and/or anonymized information.

We may user your personal information for other purposes where we have your consent or where otherwise permitted by applicable law.

5. Children’s Privacy – KT by Knix

We do not knowingly collect, maintain or use personal information from children under 16 years of age (or other age as required by local law outside of the United States), and no part of our Services is directed to children under the age of 16. If you are a parent or guardian and believe that your child has provided us with personal information without your consent, please contact us by email at info@knix.com (for Knix customers) or info@knixteen.com (for KT by Knix customers). If we become aware that we have collected personal information from a child under 16, we will promptly delete such information from our records and terminate the child’s account, if any, unless we have a legal obligation to keep it.

II.         USE OF COOKIES AND SIMILAR TECHNOLOGIES

When you use or interact with our Services, we collect information using cookies, clear-gifs (also known as web beacons or web bugs) and similar technologies.


A cookie is a small amount of data that’s stored by your browser on your device. It’s used to do things like see how you navigate our Services, what you click on, remember you and your online purchases when you return, and recognize you and honor a special deal for you, when you redeem one of our offers from a third party’s site. This helps us improve and deliver our Services, provide better customer service, tailor and improve your online experience, and tailor offers to you based on your unique tastes and your online and/or offline (e.g., in-store) interactions and purchase history.

A clear gif is a nearly invisible pixel-sized graphic image on a web page, web-based document or email message. It helps us do things like view the URL of the page on which the clear gif appears and the time the site, document or email in question is viewed; and recognize you and honor a special deal for you, when you navigate from a third party’s site to redeem one of our offers that may have appeared there. Clear gifs in emails help us confirm the receipt of, and response to, our emails, including those that you forward to friends and family; and they help deliver a more personalized or better online and offline experience.

In addition to cookies and clear gifs, we may also use device identifiers, web storage, and other technologies to collect information about your interactions with our content and Services.

These technologies, illustrated above, may be used to help us see which of our interactive experiences online users like most. Cookies, clear gifs, and similar technologies also allow us to associate your online navigational information and purchases and interactions (both online and offline) with personal information you provide (such as name, address, phone number, survey responses, and email address). As discussed below in Section V.2, we and third-party advertising partners may use cookies, pixels and similar technologies to collect information about the websites you visit and your device (e.g., your IP address, cookie identifiers, page(s) visited, location, time of day). We and our partners may use this information for our, and our partners’, business purposes, including to send online and offline communications about products and services that may be of interest to you. We or our partners may use the information we collected about your browser or device to associate it with a physical mailing address so that we can mail you advertisements and/or content we think you may be interested in and for other business purposes. For example, we use this information to: deliver products and services to you; improve our business; transact business; and market our products and services through a variety of media like email, online advertising, and direct mail.

We use third-party analytics and advertising partners to analyze site metrics and performance, analyze our visitors’ preferences, and serve personalized content to you through the use of some or all of the technologies described above, such as cookies and clear gifs.

We and/or our analytics and advertising providers may use the following types of cookies:

Strictly Necessary. These are essential to navigate the Services and use the features, and they enable us to provide the Services.

Functional. These are used to recognize you when you use the Services, and they provide enhanced functionality and more personalized features.

Performance and Analytics. These are used to improve the Services and understand how you use the Services. We use Google Analytics among other third-party analytics services for this purpose. Advertising. These are used to tailor and deliver relevant ads and track ad campaign performance and efficiency. Most web browsers allow you to set preferences about cookies you wish to accept. To control cookies on a device, consult your browser settings and follow the instructions. If you delete or block cookies, you may not be able to use or access certain features. In addition, if you delete or block cookies, access the Services from a different device, log in under a different name, or change web browsers, you will need to opt-out again.

III. INTEREST-BASED ADVERTISING

As described above, on our Services, we and third parties may collect information about your online activities to provide you with advertising about products and services tailored to your interests. We contract with third-party advertising companies, which may collect information about your use and interactions with the Services, over time and across third-party websites and online services, for use in delivering tailored advertising to you, including on other websites and online services and offline via direct mail. To tailor and deliver this advertising, these third-party companies place, use, or rely on the technologies described above, including cookies, clear gifs, device identifiers and similar technologies to obtain information about customer interactions with us through our Services and interactions with other online services. These companies use the information they collect to send you ads that are targeted to your interests.

You may stop or restrict the placement of those technologies on your device or remove them by adjusting your preferences as your browser or device permits.

To learn about how to opt out of interest-based advertising, in general, click the following: NAI Opt Out (operated by the Network Advertising Initiative or “NAI”),the European Digital Advertising Alliance, and the Digital Advertising Alliance of Canada and DAA Opt Out (operated by the Digital Advertising Alliance or “DAA”). Note, however, that not all advertising companies may participate in the NAI and DAA. Your mobile device settings may allow you to prohibit mobile app platforms (such as Apple and Google) from sharing certain information obtained by automated means with app developers like us and other businesses.

Please note you must separately opt out in each browser and on each device.

IV.  INTERACTION WITH THIRD PARTY SERVICES

We may link to third-party sites and services, or otherwise display third-party content through our Services, for your convenience and information. These third-party sites and services may operate independently from us. The privacy practices of the relevant third parties, including details on the information they may collect about you, is subject to the privacy statements of these parties, which we strongly suggest you review. To the extent any linked third-party sites and services are not owned or controlled by us, we are not responsible for these third parties’ information practices.

Here are examples of the types of third-party content and services that may be available through or via our Services:

1. Interactive Maps

We may facilitate easy access to the online maps of content providers like Google. There you can get quick location, driving, and contact information for our stores.

2. Sweepstakes, Contests, and Survey Sites

We may work with third-party service providers to run sweepstakes, contests, and surveys. Navigation to these sites may be seamless so that it appears you’re still using our Services. In these cases, the third-party’s privacy policy may apply to any personal information you provide in connection with the event. Please take note of who’s running the event in question; and the terms, conditions, and policies that apply.

3. Social Networking and other Third-Party Sites and Services

We may at times facilitate easy access to third-party sites and online services, like social networks and other services that host user-generated content. This may include easy click-through access, the ability for you to share content on third-party services, or even “single sign-on” to these services. The third-party’s privacy policy applies to any information or content you provide through these services.

V. DISCLOSURE OF YOUR PERSONAL INFORMATION

We share personal information we collect from or about you with certain third parties and service providers, as described below, and as otherwise described in this Policy. We do not sell or otherwise share personal information about you, except as described in this Policy.

1. Law Enforcement and Emergency Response

We may disclose personal information about you (a) if we are required to do so by law or legal process (such as court order or subpoena); (b) in response to requests by government agencies, such as law enforcement authorities; (c) to establish, exercise, or defend our legal rights; (d) when we believe disclosure is necessary or appropriate to prevent physical or other harm or financial loss; (e) in connection with an investigation of suspected or actual illegal activity; or (f) otherwise with your consent.

2. Service Providers, Contractors, and Advertising Partners

We share personal information with third-party service providers and contractors whom we engage to provide services to us, such as fulfilling orders; processing payments; providing customer service through chat features; monitoring activity on our Services; delivering surveys and related analysis (which could be combined with Services usage analytics); maintaining databases; hosting and operating our Services; administering, sending and monitoring emails and text messages; and providing consulting services.

We may share your personal information with third-party advertising partners. When you visit our websites, these advertising partners may use cookies, pixels and similar technologies to collect information about the websites you visit and your device (e.g., your IP address, cookie identifiers, page(s) visited, location, time of day). These advertising partners may use this information (and similar information collected from other services) to tailor and send you personalized advertisements online and offline.

We may also provide other advertising partners with personal information about your purchases with Knix, and they may use this to send you offers for Knix and other brands.

Certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

We use a third-party provider called Mimecast to provide information and cyber security services relating to email communications. Mimecast processes personal information to provide these services to us, and to provide similar services to others and for product and service improvement and development in accordance with its own privacy policy.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. If you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. Once you leave our website or are redirected to a third-party website or application, you are no longer governed by this Policy or our website’s Terms of Service.

Our website is hosted by Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our Services to you. Your personal information is stored through Shopify’s data storage, databases and the general Shopify application.

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card information. Your purchase transaction information is stored only as long as is necessary to complete your transaction. After that is completed, your purchase transaction information is automatically deleted.

3. Our Sister Brand

Knix Wear, Inc. operates two sister brands, Knix and KT by Knix, and each brand may share the information we collect about you, such as your postal and email address, customer preferences and purchase history, for our business purposes, including activities such as cross-marketing, IT management, for them to provide services to you or support and supplement the Services we provide. We will obtain your consent to this sharing to the extent required by applicable law. You may be able to opt out of certain sharing amongst our sister brands, by following the instructions in the Your Privacy Rights section below.  

4. Sale or Merger

We reserve the right to transfer your information in the event we sell or transfer all or a portion of our business assets (including, without limitation, in the event of a merger, acquisition, purchase, or sales of assets, joint venture, reorganization, dissolution, or liquidation).

VI. YOUR PRIVACY RIGHTS

1. Privacy Rights under Applicable Law

In accordance with applicable law in the jurisdiction in which you reside, you may have certain rights in connection with the personal information we collect from or about you, as described below. You may have the right to:

  • Confirm Whether We Are Processing Your Personal Information (the right to know);

  • Request Access to and Portability of Your Personal Information including: (i) obtaining access to or a copy of your personal information; and (ii) receiving an electronic copy of personal information that you have provided to us, or asking us to send that information to another company in a structured, commonly used, and machine-readable format (also known as the “right of data portability”);

  • Request Correction of your personal information where it is inaccurate or incomplete. In some cases, we may provide self-service tools that enable you to update your personal information;

  • Request Deletion of your personal information;

  • Request to Opt-Out of Certain Processing Activities including, as applicable, if we process your personal information for “targeted advertising” (as “targeted advertising” is defined by applicable privacy laws) or if we “sell” your personal information (as “sell” is defined by applicable privacy laws)

  • Request Restriction of or Object to our processing of your personal information;

  • Withdraw your Consent to our processing of your personal information. Please note that your withdrawal will only take effect for future processing, and will not affect the lawfulness of processing before the withdrawal; and

  • Appeal our Decision to decline to process your request.

If you would like to exercise any of these rights, please contact our Privacy Officer as set forth in “Questions and Contact Information” below or by completing our privacy webform. We will process such requests in accordance with applicable laws.

To protect your privacy, we will take steps to reasonably verify your identity before fulfilling requests submitted under applicable privacy laws. These steps may involve asking you to provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. Examples of our verification process may include asking you to answer questions and confirm the email address we have associated with you.


Only you, or someone legally authorized to act on your behalf in certain jurisdictions, may make a request to exercise the rights listed above regarding your personal information. If your personal information is subject to a law that allows an authorized agent to act on your behalf in exercising your privacy rights and you wish to designate an authorized agent, please provide written authorization signed by you and your designated agent using the information found in “Questions and Contact Information” below and ask us for additional instructions.


If applicable laws grant you an appeal right and you would like to appeal our decision with respect to your request, you may do so by informing us of this and providing us with information supporting your appeal.

2. Email

You may opt out of our marketing email list by following the instructions located at the bottom of each commercial email. Note that if you opt out of receiving commercial email messages from us, we may still send you operational or transactional messages, such as password-reset or account related information, from the relevant brand. We may also send you certain non-promotional communications regarding us and our Services, and you will not be able to opt out of those communications (e.g., communications regarding our Services or updates to our Terms or this Policy).

3. Mobile Text Messaging

If you’ve signed up for mobile text messaging offers but later decide you no longer wish to receive these offers, simply follow the opt-out instructions included in the mobile message.

4. Mobile Push Notifications/Alerts

With your consent, we may send push notifications or alerts to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.

5. Location Information

You may have the ability to turn precise location-based services on and off by adjusting the settings of your Internet browser or mobile device or, for some devices, by adjusting the permission settings for our mobile apps to access your location information. Precise location-based services are set to off by default.

6. Postal Mail

8. Our Sister Brands

If you don’t want Knix or KT by Knix to share your information with the other for the other brand’s own marketing purposes, please send an email to our Privacy Officer at info@knix.com (for Knix customers) or info@knixteen.com(for KT by Knix customers) and enter Nondisclosure of Personal Information Request for the Email Subject and then specify your request.

VII. INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION

If we transfer personal information which originates in the European Economic Area, Switzerland, and/or the United Kingdom to a country that has not been found to provide an adequate level of protection under applicable data protection laws, one of the safeguards we may use to support such transfer is the EU Standard Contractual Clauses.

Supervisory Authority.If your personal information is subject to the applicable data protection laws of the European Economic Area, Switzerland, or the United Kingdom, you have the right to lodge a complaint with the competent supervisory authority if you believe our processing of your personal information violates applicable law.

VIII. CHANGES TO THIS PRIVACY POLICY

This Policy may be updated periodically to reflect changes in our personal information practices. Changes and updates will take effect immediately upon their posting on this page. If we make material changes to this Policy, we will, at a minimum, notify you by posting a prominent notice on our Services indicating at the top of the Policy when it was most recently updated.
