Supplemental California Privacy Notice

Knix Wear, Inc. and its affiliates, including Knix and KT by Knix (referred to herein as “Knix,” “we,” “us,” or “our”) provides this Supplemental California Privacy Notice for residents of the State of California pursuant to the California Consumer Privacy Act of 2018 (as amended by the California Privacy Rights Act of 2020) (“CCPA”). This Supplemental California Privacy Notice supplements our Privacy Policy and only applies to our processing of personal information that is subject to the CCPA.

Notice at Collection. At or before the time of collection, California residents have a right to receive notice of our practices, including the categories of personal information to be collected, the purposes for which such information is collected or used, whether such information is sold or shared and how to opt-out of such uses, and how long such information is retained. For clarity, this Supplemental California Privacy Notice applies to personal information we collect from and about California residents that is subject to the CCPA in any form or manner, including online through our websites, mobile applications, and online and offline services (the “Services”), such as in our physical retail stores, electronically, in writing, or over the phone. This privacy notice does not apply to employment-related personal information we collect from California residents.

“Sales” of Personal Information

We “sell” this personal information to our advertising partners to provide you with advertising about Knix’s products and services. Our advertising partners may also use this personal information for their business purposes.

“Sharing” of Personal Information for “Cross-Context Behavioral Advertising”

Depending on the relationship we have with you, we may “share” the following categories of personal information for purposes of “cross-context behavioral advertising”: (i) Identifiers; (ii) Categories of personal information described in Cal. Civ. Code Section 1798.80(e); (iii) Commercial information; (iv) Biometric information; (v) Internet or other electronic network activity information; (vi) Geolocation data; (vii) inferences drawn from personal information to create a profile about a consumer; and (viii) personal information collected and analyzed concerning a consumer’s health.

We “share” this personal information with our advertising partners to provide you with advertising about Knix’s products and services. Our advertising partners may also use this personal information for their business purposes.

Non-Discrimination

California residents have the right not to receive discriminatory treatment by us for the exercise of their rights conferred by the CCPA.

Verification

To protect your privacy, we will take steps to reasonably verify your identity before fulfilling requests submitted under the CCPA. These steps may involve asking you to provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. Examples of our verification process may include asking you to answer questions and confirm the email address we have associated with you.

Authorized Agent

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. To authorize an agent, provide written authorization signed by you and your designated agent using the information found in “Questions and Contact Information” below and ask us for additional instructions.

Disclosure Regarding Individuals Under the Age of 16. Knix does not have actual knowledge of any “sale” of personal information of minors under 16 years of age. Knix does not have actual knowledge of any “sharing” of personal information of minors under 16 years of age for “cross-context behavioral advertising.”

Notice of Financial Incentive

As described in our Privacy Policy, we may offer our customers, including California consumers, various types of financial incentives, such as coupons and discounts when the sign up to receive our marketing emails, refer a friend, or join our loyalty program that provides certain rewards and offers (each, a “Program” and collectively, the “Programs”), wherein you provide your name and contact information (such as email address and/or telephone number) in exchange for a reward, or provide personal information regarding your friends or colleagues (such as their email address) and receive rewards when they sign up to use our Services. (The referred party may also receive rewards for signing up via your referral.). These programs are entirely voluntary and allow us to grow our business and provide additional benefits to you. The value of your personal information to depends on how you ultimately use our Services, whereas the value of the referred party’s personal information to us depends on whether the referred party ultimately becomes a customer and uses our Services, less the expense related to offering those products, services, and benefits to Program participants. The value will be reflected in the incentive offered in connection with each program. You may opt into a Program by following the sign up or participation instructions provided, and you may withdraw from participating in a Program at any time by unsubscribing to our emails, closing your loyalty account, or contacting us.
